01About Eflexsim
Eflexsim is on a mission to make global data connectivity simple for international travelers. We operate as a reseller of eSIM data packages, sourcing connectivity from established suppliers (currently Airalo) and offering them to our customers under the Eflexsim brand.
We provide our Platform and Services under the entity Top Explore Pte Limited, a company registered in Hong Kong with its registered office at Room A, 12/F, ZJ 300, 300 Lockhart Road, Wan Chai, Hong Kong. References to "Eflexsim", "we", "our" or "us" mean that entity. Eflexsim is a brand operated by Top Explore Pte Limited.
We act as the merchant of record for your purchase and as your first point of support. The underlying connectivity is provisioned by our supplier (Airalo) on the mobile networks they have agreements with.
Our Platform includes our website at eflexsim.com, the Eflexsim mobile app for iOS and Android, our admin dashboard at admin.eflexsim.com, and any pages we operate on social media platforms. Our Services are the eSIM data packages we sell, plus the customer support we provide alongside them.
02Acceptance of these Terms
Your use of our Services and Platform is conditional on your acceptance of these Terms. If you do not accept them or cannot comply with them, you must not access or use our Services or Platform. You agree to these Terms by using our Platform or Services, by browsing or clicking on any content, by signing up for an account, or by completing a purchase.
These Terms should be read together with our Privacy Policy, our Cookie Policy, and our Refund Policy. Together, these documents form your full agreement with Eflexsim.
03Eligibility and Capacity
To make a purchase you must be at least 18 years old (or the age of majority in your country of residence) and have the legal capacity to enter into a binding contract. Our Platform is not directed at children under 16, and we do not knowingly collect their personal data (see our Privacy Policy). If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement of a parent or guardian who accepts these Terms on your behalf.
04Updates to these Terms
We may update these Terms from time to time. We will do our best to notify you when changes are material — through an in-app notice, an email to your registered address, or a banner on the website. Any change becomes effective on the date of publication shown at the top of this page. If you no longer accept these Terms after an update, you must stop using our Services and Platform.
05Third-Party Services
Our Services include eSIM data packages provided to us by third-party connectivity suppliers, currently Airalo. The eSIM you purchase from Eflexsim is provisioned by Airalo on the underlying mobile networks they have agreements with. We act as the merchant of record for your purchase and as your first point of support, but the underlying connectivity service is provided through Airalo.
Our Platform also relies on third parties such as our payment processors, our hosting and infrastructure providers, and live-chat and analytics tools. When you interact with those third parties, their own terms and privacy policies apply in addition to ours. The third parties that process your personal data are listed in our Privacy Policy.
06Your Account
You may use Eflexsim as a guest for individual purchases, or you may create an account. Your account is personal to you and cannot be assigned or transferred to another person without our prior written consent.
You are responsible for keeping your account credentials secure. If you have reason to believe that your password or credentials are no longer secure, please change your password immediately and notify us at support@eflexsim.com.
We reserve the right to suspend or terminate your account at our sole discretion in situations such as a security concern or a suspected breach of these Terms. We will notify you when we do this, except where notification would compromise an investigation or violate the law. Where you have breached these Terms or used our Services in a manner contrary to our Acceptable Use rules below, you will not be entitled to a refund.
07Your Device
To use our Services you need an unlocked, eSIM-compatible device for which you are the sole responsible user. We provide a device-compatibility check on our product pages and in our help center. It is your responsibility to confirm your device supports eSIM before purchasing. If you purchase a Service for an incompatible device, our Refund Policy applies.
08Prices and Payments
We process payments in US Dollars (USD). We may support other currencies in the future at our sole discretion. Prices shown on our Platform do not include taxes or other applicable fees, which may be added based on your billing address at checkout.
Payments are processed by our third-party payment provider. By completing a purchase you agree to the applicable provider's terms in addition to ours. We do not store your full card details on our servers; card data is handled by our payment providers.
We take reasonable care to ensure prices are correct, but errors may occur. Where we discover an error in the price of Services you have ordered, we will contact you to confirm whether you wish to proceed at the correct price or cancel the order. If we cannot reach you, we may treat the order as cancelled and refund any amount paid.
Promotional codes and discounts are subject to their own conditions, are non-transferable, have no cash value, and may be withdrawn or amended at any time.
09Delivery and Fulfillment
Our Services are digital and delivered electronically. After your payment is confirmed, we provision your eSIM and make it available to you in your Eflexsim account and by email, normally within a few minutes. Delivery includes the information needed to install your eSIM (for example a QR code, an LPA/activation string, or a manual installation code), together with installation instructions.
It is your responsibility to provide a correct email address and to check your account and spam folder. If you have not received your eSIM details within a reasonable time after payment, contact support@eflexsim.com and we will resolve it.
By purchasing and asking us to make the eSIM available immediately, you acknowledge that delivery of digital content begins on provisioning, which affects your right of withdrawal as described in our Refund Policy.
10Service Limitations
Coverage, data speeds, and network availability depend on the underlying mobile networks operated by third parties in each destination, and may vary by location and conditions outside our control. Some plans may be subject to fair-use, throttling, or tethering conditions described on the relevant product page. We do not guarantee uninterrupted coverage in any specific location.
11Refunds
Our Refund Policy explains the circumstances in which you are entitled to a refund or replacement, the time windows that apply, and how to submit a refund request. Nothing in these Terms limits any non-waivable rights you have as a consumer under the law of your country of residence.
12Chargebacks and Payment Disputes
If you believe there is a problem with a charge or a Service, please contact us at support@eflexsim.com first — most issues are resolved quickly, and our Refund Policy sets out your options. Initiating a chargeback or payment dispute with your bank or card issuer without first contacting us can delay resolution.
We reserve the right to investigate and respond to disputes, to provide our payment providers with transaction records and evidence, and to suspend accounts associated with fraudulent or abusive chargeback activity. This does not affect any rights you have to dispute a charge that you are legally entitled to dispute.
13Service Termination and Suspension
We work with the most reliable connectivity suppliers we can find, but at times we may need to stop offering specific Services where the underlying supplier no longer meets our standards or where regulatory changes require it. Where this affects a Service you have already purchased, our Refund Policy applies.
14Acceptable Use
When you use our Platform or Services, you agree to all of the following:
- You must meet the eligibility requirements in Section 03.
- You must not resell, transfer, copy, distribute or share the Services with third parties.
- You must not impersonate another person, hide or attempt to hide your identity, or misrepresent your affiliation with any person or entity in order to access unauthorised accounts or for any other purpose.
- You must not conduct fraud or carry out any other illegal or criminal activity, or breach any applicable law.
- You must not act in any way that may impair the operation or performance of the underlying mobile networks our Services rely on.
- You must not use our Platform or Services in any way that might impair their performance, security, or functionality, or interfere with other people's use.
- You must not harass, insult, harm, abuse, defame, stalk, threaten, intimidate, or otherwise violate the legal rights of any other person, including our staff.
- You must not use our Platform or Services in any manner that could bring Eflexsim into disrepute, or to provide any commercial services without our written consent.
- You must not use our Platform or Services to develop or provide any service that competes with Eflexsim.
- You must not carry out, facilitate, permit, or authorise text mining, data mining, or web scraping of our website for any purpose without our express permission. This includes the training and development of artificial intelligence systems or models.
- You must not upload or transmit viruses or any other type of malicious code.
- You must not attempt to decipher, decompile, disassemble, or reverse engineer any of the software or algorithms we use to provide the Services.
- You must not use any automated system, including "robots", "spiders", or "offline readers", to access the Services.
- You must not transmit spam or unsolicited email, send large volumes of messages, or make public large volumes of information through our Services.
- You must not attempt to phish, spider, crawl, or scrape using our Services.
If you are in doubt as to whether a particular use is compliant with these rules, please contact us at legal@eflexsim.com. You remain solely responsible for complying with applicable local laws relating to your use of the Services.
15Intellectual Property Rights
All intellectual property rights in our Platform and Services are owned by or licensed to Eflexsim. This includes copyright (including in our software), trade marks, know-how, trade secrets, and the design, compilation, and look and feel of our Platform.
By using our Platform and Services, you agree to do so only for their intended purpose and in accordance with these Terms.
We value your feedback. Where you provide us with feedback, we may opt to incorporate it into our Services or Platform, and you confirm that no intellectual property right arises in your favour in relation to such feedback, and no compensation is due to you.
16Privacy
Your privacy is important to us. Personal data we collect about you while you use our Services or Platform is handled in accordance with our Privacy Policy and Cookie Policy.
17Disclaimer and Limitation of Liability
EXCEPT WHERE RESTRICTED BY LAW, IN NO EVENT WILL EFLEXSIM BE RESPONSIBLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT WE FAIL TO COMPLY WITH THESE TERMS, WE WILL BE RESPONSIBLE FOR YOUR FORESEEABLE LOSS AND DAMAGE, AND OUR TOTAL AGGREGATE LIABILITY TO YOU IN ANY CIRCUMSTANCES IS LIMITED TO USD 100.00 (ONE HUNDRED US DOLLARS).
OUR SERVICES AND PLATFORM ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE DO NOT GUARANTEE THAT THEY WILL BE AVAILABLE AT ALL TIMES, NOR DO WE GUARANTEE THE QUALITY OF THE UNDERLYING MOBILE NETWORK CONNECTIONS PROVIDED BY OUR SUPPLIERS. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL IMPLIED CONDITIONS, WARRANTIES, REPRESENTATIONS, OR OTHER TERMS THAT MAY APPLY TO OUR SERVICES OR PLATFORM.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, and nothing affects the statutory rights of consumers that cannot be waived or limited by contract. If you are a consumer in the EEA, the UK, or another jurisdiction that grants mandatory consumer protections, you benefit from those protections regardless of the limitations above, and the limitations apply only to the extent permitted by the law applicable to you.
TO THE EXTENT PERMITTED BY LAW, YOU WILL INDEMNIFY EFLEXSIM AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AND CONTRACTORS FOR ANY THIRD-PARTY LEGAL PROCEEDINGS (INCLUDING ACTIONS BY GOVERNMENT AUTHORITIES) ARISING OUT OF OR RELATING TO YOUR UNLAWFUL USE OF OUR SERVICES OR YOUR VIOLATION OF THESE TERMS.
18Force Majeure
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including network outages, supplier failures, acts of government, natural events, or interruptions to internet or telecommunications infrastructure. Where such an event affects a Service you have purchased, our Refund Policy applies.
19Governing Law and Courts
Irrespective of the country from which you access our Services or Platform, these Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Hong Kong, and the courts of Hong Kong shall have exclusive jurisdiction. If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of mandatory consumer-law provisions, or of the right to bring proceedings in the courts of your country of residence, where applicable law so provides.
20Class Action Waiver
To the extent permitted by applicable law, you agree that you waive the right to participate as a plaintiff or class member in any class-action proceeding, and that any proceedings to resolve disputes must be conducted on an individual basis. This waiver does not apply where it is prohibited by the law applicable to you as a consumer.
21Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to another entity (for example in connection with a merger, acquisition, or reorganisation), provided this does not reduce your rights as a consumer.
22Enforcement of Terms
If any part of these Terms is unenforceable, that part will be ignored to the extent of its unenforceability, and everything else will remain in full force. These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Eflexsim regarding your use of the Services and Platform.
